The EventCAT Terms of Service build upon the XL8 Terms of Service. Any sections not specifically addressed in the EventCAT Terms of Service will adhere to the XL8 Terms of Service. However, where the EventCAT Terms of Service provides additional or different provisions, those will take precedence.
EventCAT is a service provided by XL8 Inc. (“XL8”, “we” or “us”), located at 690 Saratoga Ave., Ste 100, San Jose, CA 95129. EventCAT services are divided into two types of service, EventCAT OnlineMeeting and EventCAT Conference. EventCAT services may be added, removed, or modified later.
EventCAT OnlineMeeting provides real-time translation for all participants, supporting over 40 languages on platforms like Zoom, Google Meet, and Microsoft Teams.
EventCAT Conference enhances your event with instant translation, offering subtitles in over 40 languages. Participants can view translated subtitles on venue screens or select their preferred language on their personal mobile devices, creating a more engaging experience.
Your use of EventCAT is subject to these EventCAT Terms of Service (“EventCAT ToS”) and the XL8 Terms of Service ("XL8 ToS") (together referred to as the “Terms”). EventCAT is a “service” as described in the EventCAT ToS. If there is any conflict between the EventCAT ToS and the XL8 ToS, the EventCAT ToS shall prevail.
You may use EventCAT to translate contents for your mobile, computer, or other supported device (“Device”). To use EventCAT, you will need a Device that meets the system and compatibility requirements for the relevant services, working Internet access, and compatible software. The availability of service will vary between countries and not all services may be available in your country. XL8 is not responsible for and does not endorse any content made available through EventCAT that originates from a source other than XL8.
EventCAT, related support libraries, may need to be updated, for example, for bug fixes, enhanced functions, missing plug-ins and new versions (collectively, “Updates”). Such Updates may be necessary in order for you to use EventCAT or to access, download, or use content. By agreeing to these Terms and using EventCAT, you agree to receive such Updates automatically.
XL8’s Privacy Policy explains how we treat your personal data and protect your privacy when using EventCAT. XL8 may need to provide your personal information, such as your name and email address, to XL8’s Affiliates for the purposes of conducting day-to-day businesses, providing, enhancing, and promoting our services, among other activities. XL8’s Affiliates agree to use this information in accordance with XL8’s privacy policies.
EventCAT services are designed to let you upload, submit, store, send, receive, or share contents.
You have no obligation to provide any content to our services and you're free to choose the content that you want to provide.
If you choose to upload or share content, please make sure you have the necessary rights to do so and that the content is lawful.
For clarity, if you are using EventCAT Online Meeting, you should explain to all participants in the online meeting that their conversation can be provided to us and obtain consent for the content provision. If you are using EventCAT Conference, you should explain that their presentation can be provided to us from the presenters who are actually presenting at the conference and obtain consent for the content provision.
You must keep your account details secure and must not share them with anyone else. You must not collect or harvest any personal data of any user of EventCAT, including account names.
If XL8 disables access to your account in accordance with the Terms (for example if you violate the Terms), you may be prevented from accessing EventCAT, your account details or any files or other content that is stored with your account.
If the EventCAT ToS changes, you will be given at least 30 days notice, and the new EventCAT ToS will be effective after such notice period. Your continued use of EventCAT following such notice period will indicate your acceptance of the new EventCAT ToS. The new EventCAT ToS will apply to your use of all services (including services you have purchased in the past) and all subsequent purchases. If you do not agree with such changes, you will be given the opportunity to terminate your use of the EventCAT.
XL8 may allow you to use EventCAT free of charge. To use EventCAT for free, you must first create an account. Additional limitations may apply to your access and use of certain free services.
After or before the free trial ends, you can extend the service usage time or open additional service functions by upgrading the plan.
The way to upgrade the plan is to purchase the usage time of EventCAT in advance (“Prepaid Plan”) or to subscribe to the service for a certain period of time (“Subscription”).
In the case of the Prepaid Plan, you can choose whether to recharge automatically or not. If you select automatic recharge and use the service beyond the time you purchased, additional payment will be made with the payment method you registered for the excess time. If you do not select automatic recharge or if the payment method you registered is not valid, the service will be terminated immediately after using all of the purchased usage time.
In the case of Subscription, the subscription will automatically be extended for that period at the end of the subscription period of your choice, and payment will be made with the payment method you registered. If payment is not made, your subscription will be canceled automatically.
When you upgrade plans, you will enter into a separate purchase contract based on these Terms (as applicable) with XL8.
Your contract for the purchase and use of EventCAT is completed once the purchase completion page is displayed on the website confirming your upgrade plan of EventCAT. The performance of this contract begins as soon as the purchase is complete.
XL8 may make available to your various payment processing methods to facilitate the purchase of service. You must abide by any relevant terms and conditions or other legal agreement that governs your use of a given payment processing method. XL8 may add or remove payment processing methods at its sole discretion. You are solely responsible for all amounts payable associated with purchases.
Pricing and availability of all EventCAT services are subject to change at any time prior to purchase.
"Taxes" means any duties, customs fees, levies or taxes (other than income tax) associated with the sale of services, including any related penalties or interest. You are responsible for any Taxes and must pay for services without any reduction for Taxes. If XL8 is obligated to collect or pay Taxes, the Taxes will be charged to you. You must comply with any and all applicable tax laws, including the reporting and payment of any Taxes arising in connection with your use of EventCAT. The reporting and payment of any such applicable Taxes are your responsibility.
If you purchased and paid for an Prepaid Plan (if you purchased the service usage time in advance), you can cancel the Prepaid Plan at any time within 12 months of the payment date. In this case, XL8 will refund the remainder of your payment, after deducting the service usage charge for the actual usage time you used and the fee for cancellation of the payment.
If you purchase the usage time at a discounted price, the actual usage charge deducted for the refund will be calculated based on the amount before the discount.
The fee for cancellation of payment is the fee that XL8 pays to the company that provides payment processing methods, which is determined by any relevant terms and conditions or other legal agreement that governs your use of a given payment processing method.
Subscriptions are automatically charged each billing period (whether monthly, annually, or daily), and you may be charged no earlier than the beginning of each billing period.
(a) Cancellations. You may cancel a subscription at any time the end of the applicable billing period, and the cancellation will apply to the next period. For example, if you purchase a monthly subscription, you may cancel that subscription at any time 24 hours before the end of the month of the subscription, and the subscription will be canceled at the end of your then-current billing period. You will not receive a refund for the current billing period.
(b) Price Increases. When you purchase a subscription, you will initially be charged at the rate applicable at the time of your agreement to subscribe. If the price of the subscription increases later, XL8 will notify you. The increase will apply to the next payment due from you after the notice, provided that you have been given at least 30 days' prior notice before the charge is made. If you are given less than 30 days' prior notice, the price increase will not apply until the payment after the next payment due. If you do not wish to pay the increased price for a subscription, you may cancel the subscription as described in the Cancellations section of these Terms, and you will not be charged further amounts for the subscription, provided you have notified us before the end of the current billing period. If your subscription is canceled and you later decide to re-subscribe, you will be charged at the then current subscription rate.
After completing a transaction or paying the applicable fees for services, you will have the non-exclusive right, solely as expressly permitted in these Terms and associated policies, to access, view, and use on your Devices or as otherwise authorized. All rights, title and interest in EventCAT and XL8 content not expressly granted to you in the Terms are reserved.
If you violate any of the Terms, your rights under this license will immediately terminate, and XL8 may terminate your access to EventCAT, the content or your account without refund to you.
You may not:
- sell, rent, lease, redistribute, broadcast, transmit, communicate, modify, sublicense, transfer, assign any XL8's services or contents to any third party except as specifically permitted and only in the exact manner provided.
- use EventCAT as part of any service for sharing, lending or multi-person use, or for the purpose of any other institution, except as specifically permitted and only in the exact manner provided.
- attempt to, or assist, authorize or encourage others to circumvent, disable or defeat any of the security features or components that protect, obfuscate or otherwise restrict access to any XL8's services.
- remove any watermarks, labels or other legal or proprietary notices included in any content, or attempt to modify any content obtained through EventCAT, including any modification for the purpose of disguising or changing any indications of the ownership or source of content.
Once the service is available to you through your account, you should check the service as soon as reasonably possible to ensure that it functions and performs as stated, and notify us as soon as reasonably possible if you find any errors or defects.
None of the XL8's services are intended for use in the operation of nuclear facilities, life support systems, emergency communications, aircraft navigation or communication systems, air traffic control systems, or any other such activities in which case the failure of the services could lead to death, personal injury, or severe physical or environmental damage.
